Terms and Conditions of Sale
Effective April 2025

These Terms and Conditions (“Agreement”) apply to all sales made by The Fifth Design PTY LTD (“we”, “us” or “our”) to the customer (“you” or “your”). By placing an order, you agree to these terms.

1. Payment Terms

1.1 First-Time Orders
For first-time clients, full payment is required upfront before production begins.

1.2 Subsequent Orders
Once a client relationship is established, approved clients may move to 30-day invoicing terms for future orders.

1.3 Website Orders
All purchases made directly through our website require full payment at the time of ordering.

1.4 Accepted Payment Methods
We accept bank transfers and credit card payments in AUD unless otherwise specified.

1.5 Late Payments
Late payments may incur interest of 5% per month or the maximum permitted by law.

2. Product Customisation & Branding

2.1 Branding Options
We offer personalised engraving and branding on select products, including chopping boards and coasters.

2.2 Pre-Production Mockups
Mockups will be provided for your review and approval before we begin production.

2.3 Branded Ribbons
On orders of 10+ units, custom ribbon branding is complimentary. Choose from a range of colours or request a match to your brand. We can also include your logo.

2.4 Processing Time
Customisation may affect production and dispatch times. We'll always communicate this clearly upfront.

3. Wine-Inclusive Gift Boxes

To comply with Australian law, any gift boxes containing wine must be shipped directly to the recipient, who must be 18 years or older.

4. Australian Consumer Law

Nothing in these terms limits your rights under the Australian Consumer Law. Our products come with guarantees that can’t be excluded. You're entitled to a refund, replacement or compensation where required.

5. Organic Materials & Natural Variation

5.1 Material Characteristics
Our resin and wood products are made using natural materials, meaning each item is one of a kind.

5.2 Variations
Colour, grain, and finish will vary slightly from piece to piece. These variations are not defects but part of the charm of handmade goods.

5.3 Sample Disclaimer
We do our best to match samples and previous orders, but an exact match cannot be guaranteed due to the nature of the materials.

7. Personalised Resin Designs

When ordering custom resin pieces, our artist will present up to 9 colour palettes inspired by your brand. Additional samples or revisions are available for $190. Resin is a fluid medium—some variation is expected and part of the creative process.

8. Product Origin

Our resin boards are handmade on the Sunshine Coast, Queensland. We partner with local suppliers and also collaborate with a small, artisanal team in India for our bowls, coasters, and cheese knives. Other perishables and items are sourced from Australian companies.

9. Shipping & Responsibility

9.1 Shipping Warranty
You may request a shipping warranty at checkout to cover any transit damage or loss.

9.2 Delivery Disclaimer
We’re not liable for damage or delays once your order has been handed over to the shipping provider. Any claims must be raised directly with the carrier.

10. General Terms

10.1 Entire Agreement
These terms represent the full agreement between you and The Fifth Design.

10.2 Amendments
Any changes to this agreement must be confirmed in writing.

10.3 Severability
If any part of these terms is found to be invalid, the rest will remain in effect.
